Terms of Service

Welcome to BumbaGame!
These Terms of Service ("Terms") are a binding agreement between you ("you" or "your") and BumbaGame Hong Kong Limited ("BumbaGame," "we," "our," or "us"), including its affiliates, parent companies, subsidiaries, licensees, and licensors. These Terms govern your use of our mobile and web-based applications ("Applications"), websites and subdomains ("Sites"), community forums or message boards ("Forums"), and related game publishing platforms ("Networks"). Collectively, these are referred to as our "Services."
PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING, DOWNLOADING, INSTALLING, OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES.
1. Changes to Terms or Services
We may modify these Terms or any part of our Services at any time, at our sole discretion. If we make material changes, we will notify you by updating the Terms here or through other communications. Your continued use of our Services after changes become effective constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Services.
2. Permitted Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not use the Services in any way that violates any applicable law or regulation or infringes upon the rights of others. You also agree not to:
· Access non-public parts of the Services;
· Attempt to interfere with the Services’ normal operations;
· Use bots, hacks, cheats, or third-party software to gain an unfair advantage;
· Upload or share offensive, harmful, or illegal content.
We reserve the right to take enforcement actions, including terminating your account, for any misuse of the Services.
3. Eligibility and Accounts
To access certain features, you may be required to register an account. If you are under the age of legal majority in your country, you must have a parent or guardian review and agree to these Terms on your behalf. You are responsible for keeping your account credentials secure and for all activity under your account.
You agree to provide accurate and current information during registration and to update it as necessary. BumbaGame reserves the right to suspend or terminate any account with inaccurate or incomplete information or for unauthorized use.
4. Privacy
We care about your privacy. By using our Services, you acknowledge that we may collect and use personal data as described in our Privacy Policy. Please review the Privacy Policy to understand how we handle your information.
5. Content Overview
There are two main categories of content in our Services:
· User Content: Any text, images, videos, or other materials uploaded, submitted, or posted by users.
· BumbaGame Content: All proprietary content provided by BumbaGame, including but not limited to game assets, designs, visuals, data, text, branding elements, and all related modifications (“Customizations”).
You retain rights to your User Content, but grant us a license to use it in connection with providing and promoting the Services. We retain all ownership of BumbaGame Content and any Customizations created using it.
6. Intellectual Property
All rights, title, and interest in and to the Services and the BumbaGame Content (including all updates and Customizations) are owned by BumbaGame or our licensors. These are protected by intellectual property laws globally. You may not use, copy, reproduce, distribute, or modify any part of the Services except as expressly allowed by these Terms.
7. License Grant
Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to install and use one copy of our Application per registered account on a device you own or control. This license is solely for personal, non-commercial use.
You may not reverse engineer, distribute, rent, lease, sublicense, or exploit our Services in any unauthorized manner. Any violation of this license may result in termination of your access to our Services.
8. User Content License
By submitting User Content, you grant BumbaGame a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, host, display, reproduce, modify, and distribute your content in connection with the Services. You retain ownership, but you are responsible for ensuring you have the necessary rights to share your content.
9. Prohibited Conduct
You agree not to:
· Violate applicable laws;
· Infringe intellectual property rights;
· Harass or abuse other users;
· Use automated tools to extract data or interact with the platform;
· Post or distribute malicious software.
Violation of these restrictions may result in legal action and immediate termination of your account.
10. Feedback
We welcome suggestions to improve our Services. Any feedback you provide may be used by BumbaGame without restriction or compensation to you. You agree that we own all rights to improvements resulting from such feedback.
11. Virtual Items
The Services may include access to virtual in-game items, currency, or points (“Virtual Items”). These are licensed to you, not sold, and remain the exclusive property of BumbaGame. Virtual Items have no cash value and cannot be exchanged for real money, refunded, or transferred except as permitted within the Services.
You agree not to trade, sell, or attempt to sell Virtual Items outside the platform. Doing so may lead to account suspension or termination. BumbaGame may modify, remove, or adjust the pricing or availability of Virtual Items at any time.
12. Purchases and Payments
All purchases of Virtual Items are final and non-refundable, unless otherwise stated. If you are a minor, purchases may only be made with the involvement of a parent or guardian. Payment transactions are processed through third-party platforms (e.g., Google Play, Apple App Store) and subject to their terms.
13. Taxes
You are responsible for paying any applicable taxes that result from your use of the Services or purchase of Virtual Items.
14. Mobile Platforms and Third Parties
You must also comply with any terms from your device’s operating system provider (e.g., Apple, Google) and other third-party application stores when using our Applications. BumbaGame is solely responsible for the Applications—not the platform providers.
15. User Interactions
You are solely responsible for your interactions with other users. BumbaGame does not actively monitor user behavior but reserves the right to take action in the event of misconduct. Exercise caution and good judgment, particularly when sharing personal information.
16. Prohibited Activities
Examples of prohibited conduct include, but are not limited to: - Harassment, threats, or hate speech; - Use of automation tools or cheats; - Spamming or reposting removed content; - Circumventing security measures; - Exploiting bugs or game mechanics for unfair advantage.
Violation of these rules may result in suspension, content removal, or account termination. BumbaGame reserves the right to investigate and take legal action if necessary.
17. Third-Party Links and Content
The Services may contain links to third-party sites or apps. We are not responsible for the content, policies, or reliability of third-party platforms. Your use of third-party content is at your own risk.
18. Promotions and Contests
Promotional activities may be hosted via the Services. Participation is voluntary and subject to additional rules, which will be clearly outlined per promotion.
19. Updates and Maintenance
We may update the Services periodically and may require you to install updates. During system maintenance, some features or all Services may be temporarily unavailable.
20. Termination
We may suspend or terminate your account without notice for violating these Terms or applicable laws. You may terminate your account at any time by contacting support. Termination results in the loss of access to your account and all associated Virtual Items.
21. Inactive Accounts
If your account remains inactive for over 12 months, it may be considered abandoned. In such cases, BumbaGame reserves the right to reclaim any remaining Virtual Items without compensation.
22. Dispute Resolution (Arbitration Clause)
Any dispute between you and BumbaGame will be resolved through binding arbitration, not in court, except where prohibited by local law. U.S. residents may opt out within 30 days of agreeing to these Terms by sending written notice to:

23. Governing Law
These Terms are governed by the laws of Hong Kong, unless otherwise required by local law. For U.S. users, any legal action not subject to arbitration must be brought in San Francisco, California.
24. Disclaimers
Our Services are provided “as-is” without warranties of any kind. We do not guarantee uninterrupted or error-free operation. Your use is at your sole risk.
25. Indemnification
You agree to indemnify and hold BumbaGame and its affiliates harmless from claims, losses, or damages resulting from your breach of these Terms or misuse of the Services.
26. Limitation of Liability
To the maximum extent allowed by law, BumbaGame’s total liability shall not exceed USD $100. We are not liable for any indirect, incidental, or consequential damages.
27. Trademarks
All BumbaGame logos, names, and other branding elements are trademarks or registered trademarks of BumbaGame or its partners. All other trademarks are the property of their respective owners.
28. Additional Mobile Platform Terms
If you use our iOS or Android Applications, you agree to abide by Apple App Store or Google Play’s terms. BumbaGame is solely responsible for the App, and neither Apple nor Google provides support for it.
29. Entire Agreement
These Terms constitute the full agreement between you and BumbaGame concerning your use of the Services and supersede any prior agreements.
30. Assignment
You may not assign or transfer your rights under these Terms without written consent. BumbaGame may assign its rights freely.
31. Notices
We may send you notices via email or through the Services. All legal notices to us must be sent to: service@bumbagame.com
32. Miscellaneous
If any part of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right is not a waiver of that right.
